Service and Usage Agreement

Firs Bilişim Service Agreement

This agreement is made between Muhammet Soyoğlu (hereinafter referred to as "First Bilişim") and the CUSTOMER to outline the terms and conditions for using products and services such as hosting, server rental, software, and internet services.

1. PARTIES

Customer:
The individual or legal entity receiving the service (hereinafter referred to as "CUSTOMER").

2. SUBJECT OF THE AGREEMENT

This agreement covers the rights and obligations regarding the products or services ordered by the CUSTOMER electronically through First Bilişim’s website. It regulates the details of the services, terms of use, and mutual responsibilities of the parties.

3. DURATION OF THE AGREEMENT

• The agreement becomes effective upon the CUSTOMER placing the order and completing the payment.
• In the event of non-payment, the service may be suspended or permanently terminated.
• The CUSTOMER has the right to cancel the service and terminate the agreement before the next payment period starts.

4. SERVICE DELIVERY AND TERMS OF USE

Service Delivery:
Service details will be sent to the email address provided by the CUSTOMER during registration. The CUSTOMER is responsible for the accuracy of the provided information.

Terms of Use:
The CUSTOMER agrees to use the service in compliance with the law and ethical standards.

5. BACKUP AND DATA LOSS

• First Bilişim may provide backup services for convenience but cannot be held responsible for data loss.
• The CUSTOMER is responsible for regular backups. First Bilişim does not guarantee data backup.

6. PROHIBITED ACTIVITIES

The following activities are not permitted:

• Illegal content and activities
• Copyright-infringing materials
• SPAM and bulk email distribution
• Illegal betting, gambling, and pyramid schemes
• Adult content, child pornography, or hacking tools

If such activities are detected, the service will be terminated without any refund.

7. PAYMENT AND REFUND TERMS

Payment:
Services are activated upon full payment. Payments are made in advance unless otherwise specified.

Refund:

• The CUSTOMER may request a refund within 3 days of the first payment date.
• Domain, ISP Dedicated, ISP VDS, ISP Proxy, SSL, licenses, and renewal services are excluded from this policy.
• Refunds will be calculated based on the unused service duration.
• For additional details, refer to the Cancellation and Refund Policy page.

8. CUSTOMER RESPONSIBILITIES

Security:
The CUSTOMER is responsible for the security of their passwords. Any damage caused by sharing passwords with unauthorized persons is the CUSTOMER’s responsibility.

Legal Liability:
The CUSTOMER assumes all legal and criminal liability for illegal content, SPAM distribution, and copyright violations. The CUSTOMER shall not engage in behavior that could harm First Bilişim’s reputation.

9. FIRST BİLİŞİM'S RESPONSIBILITIES

Technical Support:
First Bilişim provides technical support only for the services it offers. CUSTOMER’s own software is outside the scope of technical support.

Uptime Guarantee:
First Bilişim guarantees 99% uptime for service continuity, excluding maintenance work and attacks.

10. TERMINATION OF THE AGREEMENT

• The CUSTOMER may terminate the agreement by canceling the service before the payment period ends.
• First Bilişim may terminate the service if the CUSTOMER violates the terms of the agreement. In such cases, no refund will be provided.

11. JURISDICTION

Any disputes arising from this agreement will be subject to the jurisdiction of Istanbul Courts and Execution Offices.

12. FORCE MAJEURE

In cases of force majeure, such as war, natural disasters, or terrorist acts lasting more than 30 days, the agreement will automatically terminate. The parties’ rights prior to termination remain reserved.

13. DATA PROTECTION

Data Controller:
First Bilişim processes personal data in accordance with Law No. 6698 on the Protection of Personal Data.

Purpose of Data Processing:
Your data is processed to fulfill the agreement and meet legal obligations.

Data Transfer:
Data may be transferred domestically or internationally to third parties with security measures in place.

14. OTHER PROVISIONS

The CUSTOMER accepts all terms and conditions stated on First Bilişim’s website. This agreement, along with general terms of use and cancellation-refund policies, forms a whole.

15. EFFECTIVENESS

This agreement takes effect when the CUSTOMER purchases the service. First Bilişim reserves the right to modify the terms of the agreement. Staying informed of changes is the CUSTOMER’s responsibility.
