First Bilişim Service Agreement
1- Parties
1.1: This agreement is made between Muhammet Soyoğlu (hereinafter referred to as First Bilişim), who provides the services specified in the Services section, and the individual/entity specified in the new customer registration section (hereinafter referred to as the Customer), regarding the use of the website operated at https://www.firstbilisim.com (also referred to as First Bilişim) and the services to be purchased through this site, under the terms and conditions stated below, which are deemed signed.
1.2: The parties declare, accept, and undertake the accuracy of the information written in this agreement.
2- Subject
2.1: This agreement regulates the permissions granted or withheld by the customer regarding the operations, orders, messages, and registration data provided during site usage, and the fees the customer will pay to First Bilişim in exchange for the services chosen according to their preferences. Service and transaction descriptions are as follows.
2.2: Membership information is the data entered by the customer during registration. Since these data will be used as a basis for transactions, it is assumed that the customer/member has entered the data accurately and completely.
3- Responsibilities
3.1.1: First Bilişim will provide the services requested by the customer upon their order. By sending an order acceptance message, First Bilişim acknowledges receipt of the payment and commits to providing the specified service.
3.1.2: Payment method and VAT differences will be indicated along with the total amount to be paid, and First Bilişim will notify the customer of fees based on their monthly or annual payment preferences.
3.1.3: After order acceptance and approval, First Bilişim will provide the customer with usernames and passwords for control panels, FTP, SQL, and email related to the ordered service. Responsibility for these credentials lies with the customer, who is liable for any resulting damages or losses.
3.1.4: The customer agrees to comply with all declarations and warnings issued by First Bilişim regarding the service. The customer agrees to follow all notices and warnings published by First Bilişim while using their hosting account. The customer may not redistribute, resell, or commercially use any free or paid services obtained through First Bilişim to third parties.
3.1.5: The customer commits to not accessing files or programs they are not authorized to access and to bear any damages caused by such unauthorized access.
3.1.6: The customer accepts responsibility for all taxes, fees, and similar obligations related to the use of domain, hosting, or other services during the contract term.
3.1.7: The customer is responsible for all files, documents, software, websites, email services, and other operations related to the service, and for any legal or criminal liabilities arising from unlawful content or statements. First Bilişim does not review, verify, or assume responsibility for content published by the customer and may terminate accounts violating these terms without notice. First Bilişim has the right to delete unlawful content immediately upon discovery without informing the customer.
3.1.8: First Bilişim is not liable for any material or moral damages caused by improper use or content of customer data, emails, or other services. Backup and data storage responsibilities belong to the customer. First Bilişim will perform regular backups and maintenance but is not liable for any service interruptions or data loss. Email message backups are done every 3 months, while weekly backups exclude email messages. Customers are advised to regularly back up emails using POP3-compatible software such as Outlook.
3.1.9: First Bilişim will handle domain registration for fully paid orders. The domain owner is the customer. Domains obtained via promotions can be transferred only after the next payment period. First Bilişim will act according to customer requests regarding domains, which the customer must promptly provide.
3.2.0: To prevent excessive email accumulation, First Bilişim automatically deletes emails older than 3 months from servers. Customers are advised to back up important emails using software like Outlook.
3.2.1: Unless otherwise stated, all hosting packages have a daily sending limit of 350 emails per domain. Accounts exceeding this limit within 24 hours will be suspended from sending emails.
3.2.2: If more than 1000 emails accumulate in a single mailbox, First Bilişim will begin deleting messages older than 3 months automatically.
3.2.3: All hosting and email packages are limited to 100,000 inodes (objects). First Bilişim reserves the right to suspend accounts exceeding this limit.
3.2.4: On all shared hosting packages, the "php mail()" function is disabled to prevent unauthorized spam emails. PHP mail must be sent via SMTP connection.
4- Duration
4.1: This agreement comes into effect once the customer completes order and payment procedures on First Bilişim's website.
4.2: The contract duration corresponds to the payment period selected by the customer at order.
4.3: If neither party notifies 10 business days prior to the end of the contract term, the agreement will automatically renew for the same period under the same terms and conditions (subject to fee changes).
5- Fees
5.1: First Bilişim may request fees from the customer as indicated on the site and order details at the time of ordering.
5.2: Payments must be made in advance. If the customer fails to pay, First Bilişim reserves the right to suspend, cancel, or suspend services.
5.3: Payments are considered inclusive of VAT and other taxes.
6- Cancellation and Refund
6.1: Customers must carefully review product and service details before ordering.
6.2: After order completion and payment, cancellations or refunds are not possible. However, if there are errors or deficiencies caused by First Bilişim, these will be addressed through customer communication.
7- Confidentiality
7.1: Parties shall protect each other's trade secrets, customer data, and private information and shall not share with third parties.
7.2: All information provided by the customer to First Bilişim shall be kept confidential and used solely for service provision.
8- Prohibition of Resale and Transfer of Services
8.1: The CUSTOMER may not directly or indirectly sell, rent, transfer, or commercially use any services provided by First Bilişim (including Turkey VDS, USA VDS, ISP VDS, hosting, domain, etc.) without written permission from First Bilişim (except reseller hosting).
8.2: Violation of this clause authorizes First Bilişim to suspend, permanently terminate, or immediately cancel the relevant service without notice. No refunds will be provided. First Bilişim reserves the right to claim damages for any direct or indirect losses incurred.
9- Default on Payment
9.1: If the customer fails to pay within 7 days after the application date, they are considered in default. First Bilişim may issue an exchange difference invoice or charge a monthly 15% late payment interest from the invoice date. The customer agrees to pay such fees.
9.2: In case of legal or enforcement proceedings for receivables, the customer agrees to pay a 15% monthly late interest, a penalty of 50% of the outstanding debt, 10% attorney fees, and all related legal expenses.
9.3: If precautionary attachment or injunction is requested for collection of receivables, First Bilişim is authorized to obtain such orders without collateral, and if courts require collateral, the customer will bear all related fees and commissions without objection.
10- Enforcement and Jurisdiction
10.1: This agreement becomes effective when the customer completes order and payment procedures.
10.2: Istanbul courts and enforcement offices have jurisdiction over disputes between parties.
10.3: This agreement consists of 10 articles and sub-clauses, has been read and understood by the parties, and is deemed signed (signing occurs by sending the order online to First Bilişim). First Bilişim reserves the right to add, remove, or amend articles as deemed necessary. The customer agrees to these changes in advance.
